CDC's Federal Eviction Moratorium Overturned

On Wednesday, May 5th, Federal Judge Dabney Friedrich overturned the CDC’s national eviction moratorium. Source.  While Tiner Property management is very happy to see the Federal court acknowledge private property rights - and that the CDC’s eviction ban was an overstep of their authority - this Federal court decision will NOT impact California property owners.The California eviction moratorium will remain in place until July 1, 2021. There is good news for Caifornia Landlords

Governor Newsom has promised 100% rent repayment to landlords whose low-income tenants have been unable to pay all or part of their rent. California has reported an unprecedented $76 billion dollar surplus, with an anticipated additional $26 billion of federal aid.  Governor Newsom has laid out a plan for utilizing the extra $100 billion in funds that includes $5 billion to be allocated to pay past due rent balances. Source. 


The Sacramento Housing and Redevelopment Agency began accepting applications from Tenants and Landlords for the “Sacramento Emergency Rental Assistance (SERA) Program on March 11 for past due rents from March 2020 - March 2021.  SHRA opened the application period for tenants with past due rents April 2021 - June 2021 on May 11.  All applications already submitted for the original coverage period will also be considered for the new extended period without any need to reapply.  Tiner Properties is helping with the SHRA application process for the few clients we have whose tenants have been unable to keep up on their payments. Landlords with delinquent tenants that are not professionally managed by Tiner Property Management may apply for state funds here.

Effective July 1, 2024, AB 12 introduces significant changes to security deposit caps for rental properties. Under the new law, the maximum security deposit allowed will be reduced to one month's rent for both furnished and unfurnished units. However, small landlords owning two residential rental properties with four doors or less are exempt from this change. Property owners already holding deposits exceeding one month's rent are grandfathered in. Professional property managers are adjusting their policies to comply with the new law, with many opting for a flat security deposit rate of one month's rent. SB 91 was passed into law 1/29/21 and it is the newest COVID legislation. It provides a plan for relief for landlords and tenants who need it most.
